Rental Terms & Conditions

Rental Agreement

By renting any equipment from SA Vurkhyser Oplossings (PTY) LTD, the Customer agrees to the following Rental Terms and Conditions.

These terms apply to all forklift rentals, golf cart rentals, industrial equipment rentals, machinery rentals, batteries, attachments, and related equipment supplied by SA Vurkhyser Oplossings (PTY) LTD.

Rental Period

The rental period commences on the date the equipment is delivered to or collected by the Customer and continues until the equipment is returned and inspected by SA Vurkhyser Oplossings (PTY) LTD.

Additional charges may apply for late returns.

Rental Payments

All rental fees are payable in advance unless otherwise agreed in writing.

The Customer agrees to pay:

• Rental charges

• Delivery and collection fees

• Damage costs where applicable

• Cleaning fees where necessary

• Any additional charges incurred during the rental period

Failure to make payment may result in the immediate termination of the rental agreement and recovery of the equipment.

Delivery & Collection

Delivery and collection services can be arranged at an additional cost.

The Customer is responsible for ensuring safe and reasonable access to the delivery location.

Any delays caused by inaccessible sites or customer-related issues may result in additional charges.

Customer Responsibilities

The Customer agrees to:

• Operate equipment safely and responsibly.

• Ensure operators are properly trained and qualified.

• Use equipment only for its intended purpose.

• Comply with all applicable laws, regulations, and safety requirements.

• Perform routine daily inspections where applicable.

• Immediately report any faults, defects, or damage.

The Customer shall not:

• Modify or alter the equipment.

• Sub-rent or transfer the equipment to another party.

• Remove identification plates or safety labels.

• Use the equipment for unlawful purposes.

Equipment Condition

All equipment is inspected prior to delivery.

The Customer acknowledges that the equipment is received in good working condition unless otherwise stated.

The Customer is responsible for inspecting the equipment upon delivery and reporting any issues immediately.

Damage, Loss & Theft

The Customer accepts full responsibility for:

• Loss of equipment

• Theft of equipment

• Fire damage

• Vandalism

• Negligent operation

• Accidental damage during the rental period

Any repair or replacement costs resulting from damage, loss, misuse, negligence, or theft will be charged to the Customer.

The Customer is encouraged to ensure adequate insurance coverage for rented equipment.

Maintenance & Breakdowns

SA Vurkhyser Oplossings (PTY) LTD will maintain equipment under normal operating conditions.

Customers must immediately cease operation and notify us if any mechanical fault occurs.

Unauthorized repairs may void any support obligations and costs incurred may become the responsibility of the Customer.

Fuel, Batteries & Charging

The Customer is responsible for:

• Fuel costs during the rental period.

• Proper charging of electric equipment and batteries.

• Following manufacturer operating guidelines.

Damage caused by incorrect charging, overloading, misuse, neglect, or improper operation will be charged to the Customer.

Insurance

The Customer remains responsible for the equipment throughout the rental period.

SA Vurkhyser Oplossings (PTY) LTD recommends that Customers obtain adequate insurance coverage against:

• Theft

• Damage

• Fire

• Accidental loss

• Third-party liability

Limitation of Liability

SA Vurkhyser Oplossings (PTY) LTD shall not be liable for:

• Business interruption

• Loss of profits

• Loss of contracts

• Delays

• Consequential losses

• Indirect damages

The Customer accepts all risks associated with the use of rented equipment.

Equipment Recovery

Should rental payments become overdue or should the Customer breach these Terms and Conditions, SA Vurkhyser Oplossings (PTY) LTD reserves the right to recover the equipment without prior notice.

Any recovery costs incurred will be charged to the Customer.

Cancellation Policy

Rental bookings cancelled less than 48 hours before the scheduled delivery date may be subject to cancellation charges.

Special-order or custom equipment may be non-refundable once confirmed.

Force Majeure

SA Vurkhyser Oplossings (PTY) LTD shall not be liable for delays or failure to perform due to events beyond its reasonable control, including:

• Natural disasters

• Floods

• Fires

• Strikes

• Civil unrest

• Government restrictions

• Transport disruptions

Governing Law

These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

Any disputes arising from the rental agreement shall be subject to the jurisdiction of the South African courts.
